Terms of Service

1. Acceptance of Terms

By accessing or using the Launch at Dawn platform (the "Service") at www.launchatdawn.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement between you ("User," "you," "your") and Launch at Dawn ("we," "us," "our").

2. Description of Service

Launch at Dawn is an AI visibility tracking platform that helps businesses monitor and improve how they appear in AI-powered search engines and assistants (ChatGPT, Gemini, Claude, Perplexity, etc.). The Service includes:

  • AI visibility scanning and scoring
  • Prompt tracking and analytics
  • Competitor analysis
  • AI crawler traffic monitoring (Agent Analytics)
  • Fix kits and outreach tools
  • Integration with third-party services (WordPress, GitHub, Slack)

3. Account Registration

  • You must provide accurate and complete registration information
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must be at least 16 years old to create an account
  • One person or entity may not maintain more than one free account
  • You agree to notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree NOT to:

  • Use the Service for any unlawful purpose or in violation of any applicable law
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Use the Service to transmit malware, spam, or other harmful content
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated tools (bots, scrapers) to access the Service except as intended
  • Resell or redistribute the Service without written authorization
  • Use AI-generated content from the Service to train competing products
  • Attempt to manipulate or game AI visibility scores

5. Subscriptions and Payment

  • Paid plans are billed in advance on a monthly or annual basis via Stripe
  • Prices are in USD unless otherwise stated
  • You may cancel your subscription at any time from your dashboard settings
  • Cancellation takes effect at the end of the current billing period — no partial refunds
  • We reserve the right to change pricing with 30 days' notice
  • Free plans are subject to usage limits as described on our pricing page

6. Intellectual Property

Our IP

The Service, including its design, code, content, and branding, is owned by Launch at Dawn and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.

Your Data

You retain all rights to your business data, prompts, and content. We do not claim ownership over your data. By using the Service, you grant us a limited license to process your data solely to provide the Service.

AI-Generated Content

Content generated by the Service (reports, fix kits, growth plans, drafts) is provided for your use. You are responsible for reviewing AI-generated content before publishing or acting on it.

7. Third-Party Integrations

The Service integrates with third-party platforms (WordPress, GitHub, GitLab, Bitbucket, Slack, Stripe). Your use of these integrations is subject to their respective terms of service. We are not responsible for the availability, accuracy, or policies of third-party services.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that AI visibility scores, rankings, or analytics will be accurate, complete, or current. AI model responses are generated by third-party services and may contain errors or inaccuracies.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LAUNCH AT DAWN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Launch at Dawn from any claims, losses, or damages arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

  • You may terminate your account at any time from your dashboard settings
  • We may suspend or terminate your access for violation of these Terms
  • Upon termination, your right to use the Service ceases immediately
  • We will delete your data within 30 days of termination (see our Privacy Policy)

12. Governing Law

These Terms are governed by the laws of the Province of Quebec, Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Montreal, Quebec.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or prominent notice on the Service. Continued use after changes take effect constitutes acceptance.
